FSSAI initiates legal action against Nestle India over infant nutrition products

New Delhi: The Food Safety and Standards Authority of India (FSSAI) on Friday said it has initiated legal action against Nestle India Ltd over alleged non-compliance with food safety norms in three infant nutrition products. The regulator examined NAN Excella Pro Stage 1, Lactogen Pro 1 and a follow-up formula, along with promotional material on e-commerce platforms.

FSSAI flagged promotional claims related to “5HMOs” and “Whey Protein” in NAN Excella Pro Stage 1 and a “Whey Protein” claim in Lactogen Pro 1. It said the claims violated provisions under the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020, and the 1992 law governing the promotion of infant foods. Separately, a follow-up formula was found non-conforming for Biotin content after re-analysis.

The regulator said it has filed three separate adjudication cases against Nestle India concerning the products. Following the announcement, Nestle India shares were down nearly 2% at Rs 1,345.45 on the BSE at 1:10 pm.
