The Uniform Civil Code (UCC) will be implemented in Uttarakhand today, marking it as the first state in independent India to adopt a unified framework governing civilian matters, including marriage, divorce, and inheritance, while excluding tribal communities from its provisions.
Being a state legislation, the UCC will only be in effect within Uttarakhand and will not extend nationwide. This contrasts with the arguments put forth by the BJP-led Sangh Parivar advocating for a uniform civil law applicable across the entire country. Other states considering the implementation of a uniform civil code may choose to adopt varied provisions, which could compromise the principle of uniformity that the term implies.
The handling of issues and cases arising within a state, particularly in relation to citizens relocating to other states, remains an unresolved matter. Questions regarding jurisdiction, specifically concerning the residence of the parties involved, are likewise ambiguous. Chief Minister Pushkar Singh Dhami articulated on Sunday that the implementation of the Uniform Civil Code (UCC) is anticipated to foster uniformity across society and to ensure equal rights and responsibilities for all citizens. He indicated that all necessary preparations for the law's implementation are currently underway. obtaining approval for the rules and training concerned officials, have been completed.
